You may visit the Civil Division of the Clerk’s office during the hours of 8:30 am to 4:30 pm Monday through Friday. You can also call the civil department at (216) 491-1308.The Civil Division handles cases seeking monetary damages of $15,000.00 or less.

The general civil division is also responsible for forcible entry and detainer cases, which are known as evictions. Eviction cases are governed by Ohio Revised Code Chapter 1923. There is a filing fee to file an eviction action. If there is more than one defendant, there is an additional fee per defendant. If the eviction is granted, A Writ of Restitution should be obtained at the Clerk’s window. The Writ of Restitution orders Defendant(s) to move by a date specified on the date of the hearing. There is a fee to obtain a Writ of Restitution.

New civil cases, including any subsequent pleadings, motions, or post-judgment executions (such as wage garnishments or bank attachments) are filed with the civil division.

Corporations appearing in the Shaker Heights Municipal Court are required to be represented by counsel in Court appearances and pleadings, eviction proceedings, and post-judgment executions.

Mediation

Parties to a civil case may have the option to mediate their claims if assigned to mediation by the Magistrate. Mediations are conducted on Tuesday or by special appointment. Mediations are conducted remotely via the Zoom platform.
